The judge did declare a mistrial, and he had no other option. Eleven out of twelve is not a unanimous jury verdict, and the lone dissenting juror cannot be coerced. The judge is going strictly by the book on a first degree murder trial and he has absolutely no say on whether or not the defense chooses to seek an emergency appeal within that time limit. As a lower court judge he is simply explaining the defense attorney's options and acknowledging an established time limit for filing a so-called “emergency” appeal.
